WILMINGTON, Del. – A federal jury is about to hear an appeal from a South African dentist who claimed that the Food and Drug Administration (FDA) failed to warn about the drug Xenical (orlistat) after it was found in his system.
Dr. Adesha Nkubu, a consultant obstetrics and gynecology at the University of Ife, told the jury that the FDA has warned about the potential risk of severe liver injury in patients taking the drug.
The jury's verdict was sealed, and Dr. Nkubu will now appeal. The FDA is the U. S. Food and Drug Administration’s regulator of drugs that cause liver injury and related conditions. The FDA has a long history of warnings about the dangers of the drug.
The jury heard that Dr. Nkubu failed to properly warn about the risk of severe liver injury after it found Xenical in his system. In addition, the FDA had a policy that advised patients not to use Xenical after experiencing a liver injury and to report any symptoms or side effects to the patient's physician.
The jury ordered the FDA to pay $7.5 million, plus $500,000 in costs and $300,000 in punitive damages, for the drug.
Nkubu's appeal was not successful.
The FDA is appealing the verdict.
The appeal was heard by the U. Judicial Panel on Multidistrict Litigation (JPML). The JPML has filed a motion for a new trial.
"The FDA is not the only authority that is responsible for its regulatory oversight of the use of drugs in patients and the use of the drug in other countries," said Dr. Nkubu.
Nkubu's claim that the FDA failed to warn about the potential risk of liver injury from the drug was not supported by substantial evidence.
"The FDA did not provide the information to the jury on this issue," said Dr.
The FDA has been investigating Xenical for at least 15 years, but the drug is not yet approved in the U. and has not been approved for the treatment of obesity.
Nkubu also told the jury that he has not received any scientific advice regarding the drug's potential risks.
Nkubu also urged the jury to impose strict liability on the FDA, arguing that the FDA has failed to provide adequate warnings to patients.
